TERMS AND CONDITIONS for the ‘MORTGAGE CHOICE ESCAPE ON YOUR DREAM HOLIDAY’ WINTER / SPRING 2008 PROMOTION
1. The promotion is organised by Mortgage Choice Limited ABN 57 009 161 979 ('Mortgage Choice') Level 7, 182-186 Blues Point Road, North Sydney, NSW 2060.
2. Information on how to enter and prizes form part of these Terms and Conditions.
3. Entry is only open to Australian residents aged 18 years or over.
4. To enter, you must either make an appointment with a Mortgage Choice consultant by phone (1800 110 170) or complete the Mortgage Choice entry form on www.mortgagechoice.com.au or enclosed in the Winter/Spring 2008 edition of the 'Mortgage Choices' newsletter. The entry form can be either posted to: Mortgage Choice Escape on your Dream Holiday Promotion, Reply Paid 74789, McMahon's Point, NSW 2060 or faxed to us on: (02) 9954 4913.
5. Employees and their immediate families of Mortgage Choice and the agencies associated with this promotion, Mortgage Choice franchisees and their employees and the immediate families of Mortgage Choice franchisees and their employees are ineligible.
6. The Winter/Spring 2008 promotion of the 'Mortgage Choice Escape On Your Dream Holiday’ commences on 1st August 2008. All entries for the Winter/Spring promotion must be received by Mortgage Choice by 9am Eastern Standard Time on 3rd November 2008. The draw will take place at Mortgage Choice's office at 4pm Eastern Standard Time on 4th November 2008. The winner will be notified by telephone and confirmed by mail and their name will be published in The Australian on 7th November 2008.
7. The prize for the Winter/Spring 2008 promotion is $6,000 deposited into an account in the winner’s name at the winner’s nominated Flight Centre shop.
8. The promotion consists of 1 draw with the first valid entry to win. The prize must be taken within 12 months of the date of opening the account.
9. The prize is not redeemable for cash or travellers cheques. The prize able to be partially redeemed and it is up to the prize winner to use the full value of the account within the validity period. Any unused balance will not be refunded or credited when the account expires. Where the cost of purchase exceeds the available balance, the account holder will be required to make up the difference between the purchase price and the account balance. The store is not obliged to accept use of this account on a sale under $20. The Mortgage Choice accepts no responsibility for any variation in the value of the prize. For each draw, the judge's decision is final and no correspondence will be entered into.
10. All prize values are in Australian dollars. All prize winners are advised that tax implications may arise from their prize winnings and they should seek independent financial advice prior to acceptance of their prize.
11. No responsibility is accepted for late, lost or misdirected entries.
12. Mortgage Choice shall not be liable for any loss or damage whatsoever, suffered (including, but not limited to indirect or consequential loss) or for any personal injury suffered or sustained as a result of taking the prize, except for any liability which cannot be excluded by law.
13. Should the prize for the Winter/Spring 2008 promotion remain unclaimed, Mortgage Choice may conduct a further draw as is necessary at the same place as the original draw in order to distribute the prize. The draw, if necessary, for any unclaimed prize, will be held at Mortgage Choice's office on 3rd February 2009 at 4pm Eastern Standard Time. The winner, if any, of this draw will have their names published in The Australian on 6th February 2009.
14. All entries become the property of Mortgage Choice. Mortgage Choice may use the name, address and other personal information provided by the entrant. All personal details of the entrant will be stored at the office of Mortgage Choice. Mortgage Choice may require the winner from the Winter/Spring 2008 promotion to partake in any media exposure, including but not limited to promotional, marketing and publicity activities without any further reference or payment or other compensation.
15. The winners' personal information may be disclosed to State and Territory lottery departments as required by law and the winners' names published as required under relevant legislation. Mortgage Choice may use the information collected by Mortgage Choice from the ‘Mortgage Choice Escape on Your Dream Holiday Promotion’ for marketing purposes.
