MORTAGE CHOICE

TERMS AND CONDITIONS for the‘MORTGAGE CHOICE ESCAPE ON YOUR DREAM HOLIDAY’ AUTUMN / WINTER 2008 PROMOTION

1. The promotion is organised by Mortgage Choice Limited ABN 57 009 161 979 ('Mortgage Choice') Level 7, 182-186 Blues Point Road, North Sydney, NSW 2060. 
2. Information on how to enter and prizes form part of these terms and conditions.
3. Entry is only open to Australian residents aged 18 years or over.
4. To enter, you must either make an appointment with a Mortgage Choice consultant by phone (13 MORTGAGE) or complete the Mortgage Choice entry form on www.mortgagechoice.com.au or enclosed in the Autumn/Winter 2008 edition of the 'Mortgage Choices' newsletter. The entry form can be either submitted online or posted to: Mortgage Choice Escape on your Dream Holiday Promotion, Reply Paid 74789, McMahon's Point, NSW 2060 or faxed to us on: (02) 9954 4913. The entry form will require name, address and contact number details. Only one entry per person will be accepted. By entering the draw, you acknowledge that you have read and understand and agree to be bound by these terms and conditions.
5. Employees and their immediate families of Mortgage Choice and the agencies associated with this promotion, Mortgage Choice franchisees, their employees and immediate families are ineligible to enter.
6. The Autumn/Winter 2008 'Mortgage Choice Escape On Your Dream Holiday’ promotion commences at 9am AEST on 1 May 2008 and finishes at 5pm AEST on 31 July 2008. Entries received after this time will not be valid.
7. The promotion consists of 1 prize draw with the first valid entry drawn to win.
8. The draw will take place at Mortgage Choice's office at 182 Blues Point Road, North Sydney, NSW 2060 at 4pm AEST on 1st August 2008. The winner will be notified by telephone and confirmed by mail and their name will be published in The Australian on 5 August 2008. The prize for the Autumn/Winter 2008 promotion is $6,000. The prize will be deposited by Mortgage Choice into an account in the winner’s name at a Flight Centre branch nominated by the winner. The Flight Centre branch must be notified to Mortgage Choice by the winner at the time of claiming the prize. The winner must provide to Mortgage Choice all information and reasonable assistance necessary in order to enable Mortgage Choice to facilitate this transaction.
9. The prize must be redeemed with the Flight Centre branch for Flight Centre services such as flights and/or accommodation within 12 months after the winner's account is opened. In doing so, the winner must comply with all Flight Centre terms and conditions relevant to the account. The prize is not transferable nor is it redeemable for cash or travellers cheques. The prize can be partially redeemed and it is up to the prize winner to use the full value of the prize within the 12 month validity period. Any unused balance will not be refunded or credited on expiry of this period. Where the cost of purchase exceeds the available balance, the account holder will be required to make up the difference between the purchase price and the account balance. The Flight Centre branch may, in its discretion, disallow purchases of less than $20 using the prize. Mortgage Choice accepts no responsibility for any variation in the value of the prize.
10. The result of any draw is final and no correspondence will be entered into.
11. Prize values are in Australian dollars. The prize winner should be aware that tax implications may arise as a result of claiming the prize and should seek independent financial advice prior to claiming the prize.
12. No responsibility is accepted for late, lost or misdirected entries.
13. Mortgage Choice shall not be liable for any loss or damage whatsoever suffered (including, but not limited to, indirect or consequential loss) or for any personal injury suffered or sustained as a result of taking the prize, except for any liability, which cannot be excluded by law. 
14. Should the prize for the Autumn/Winter 2008 promotion remain unclaimed, Mortgage Choice may conduct a second chance draw at Level 7, 182-186 Blues Point Road, North Sydney, NSW 2060 at 4pm AEST on 4th November 2008, subject to any directions given by any relevant State or Territory department or authority. The winner will be notified by telephone and confirmed by mail and will have their name published in The Australian on 7^th November 2008.
15. All entries become the property of Mortgage Choice. Mortgage Choice may use the name, address and other personal information provided by the entrant. All personal details of the entrant will be stored at the office of Mortgage Choice. Mortgage Choice may require the winner from the Autumn/Winter 2008 promotion to partake in any media exposure, including but not limited to promotional, marketing and publicity activities without any further reference or payment or other compensation.
16. The winners' personal information may be disclosed to State and Territory lottery departments as required by law and the winners' names published as required under relevant legislation. By entering the competition, the entrant consents to Mortgage Choice using their personal information for marketing and promotional purposes. If, after entering the competition, the entrant wishes Mortgage Choice to cease using their personal information for marketing and promotional purposes, the entrant should contact Mortgage Choice on the details listed below.
17. A copy of the Mortgage Choice Privacy Policy may be obtained by visiting www.mortgagechoice.com.au and following the relevant links. A request to access, update or correct any information should be specifically directed to Mortgage Choice at Level 7, 182-186 Blues Point Road, North Sydney NSW 2060 by logging onto the Mortgage Choice website at www.mortgagechoice.com.au.
